WHAT IS INDECENT EXPOSURE?

NRS 201.220 states that it is illegal for a person to make “any open and indecent or obscene exposure of his or her person, or of the person of another.” In other words, indecent exposure is the act of intentionally showing one’s sexual organs in public. Even innocent acts such as “mooning” can be considered acts of indecent exposure. It is important to note that breastfeeding a child in public does not constitute indecent exposure.

PENALTIES FOR INDECENT EXPOSURE IN LAS VEGAS:

  • For a first offense, you will be convicted of a gross misdemeanor.

  • For any subsequence offense, or if you have been previously convicted of a sexual offense, you will be convicted of a category D felony and will be punished:

    • A minimum term of 1 year and a maximum terms of 4 years in a state prison, and

    • A possible fine of no more than $5,000.

  • If the indecent exposure was done in the presence of a child under 18 years old or any person who suffers a physical or mental incapacitation, you will be convicted of a category D felony and will be punished:

    • A minimum term of 1 year and a maximum terms of 4 years in a state prison, and

    • A possible fine of no more than $5,000.

DEFENSES TO INDECENT EXPOSURE CHARGES IN LAS VEGAS:

  • The act was not done intentionally. If the indecent exposure was an unintentionally act, then you cannot be charged with the crime.

  • Insufficient evidence. If the prosecution has insufficient evidence to demonstrate a person committed the crime of indecent exposure, then they cannot meet their burden in order to convict a person of the crime.
